ACCEPTABLE USE POLICY¶

This Acceptable Use Policy establishes comprehensive, legally binding requirements for the proper and lawful use of the Brilio platform, providing a globally defensible framework for user conduct standards, content restrictions, and platform integrity protection.

1. PURPOSE AND SCOPE¶
1.1 Policy Objectives¶
This Policy ensures that the Brilio platform is used in a manner that: - Protects the rights and safety of all users - Maintains platform security and integrity - Complies with applicable laws and regulations - Upholds community standards and values - Supports responsible AI development and deployment
1.2 Applicability¶
This Policy applies to all users of the Brilio platform, including account holders, AI agent creators, API users, and any third parties accessing platform services.
2. GENERAL CONDUCT REQUIREMENTS¶
2.1 Fundamental Standards¶
When using the Platform, you must: - Comply with all applicable laws, regulations, and third-party rights - Use the Platform only for lawful purposes - Provide accurate and current account information - Maintain the security and confidentiality of your account credentials - Respect intellectual property, privacy, and other rights of all parties - Act with integrity, professionalism, and respect toward other users - Report security vulnerabilities, policy violations, or illegal activities promptly
2.2 Account Responsibilities¶
- Maintain accurate and up-to-date account information
- Use strong, unique passwords and enable available security features
- Monitor account activity and report unauthorized access immediately
- Comply with any specific terms applicable to your account type
- Ensure all authorized users under your account comply with these policies
3. PROHIBITED USES AND CONTENT¶
3.1 Illegal Activities¶
You may not use the Platform to: - Engage in or facilitate any illegal activities - Violate any applicable laws or regulations - Infringe upon intellectual property rights - Distribute malicious software or code - Engage in fraud, money laundering, or financial crimes - Facilitate human trafficking or exploitation
3.2 Harmful Content¶
Prohibited content includes: - Content that promotes violence, hatred, or discrimination - Sexually explicit or pornographic material - Content that exploits, abuses, or endangers children - Material that promotes self-harm or suicide - False or misleading information that could cause harm - Content that violates privacy or dignity of individuals
3.3 Platform Abuse¶
You may not: - Attempt to gain unauthorized access to platform systems - Interfere with or disrupt platform services or infrastructure - Use automated tools to abuse platform features or circumvent limitations - Create multiple accounts to evade restrictions or limitations - Engage in activities that could damage platform reputation or operations - Attempt to reverse engineer, decompile, or extract platform algorithms
3.4 Security Violations¶
Prohibited security-related activities include: - Attempting to breach platform security measures - Scanning, testing, or probing platform systems for vulnerabilities - Distributing viruses, malware, or other malicious code - Engaging in denial-of-service attacks or similar disruptions - Attempting to access data belonging to other users
3.5 Prohibited AI Practices¶
The following AI-specific practices are strictly prohibited on the Brilio platform, in addition to the general prohibitions in Sections 3.1–3.4. These prohibitions reflect Article 5 of the EU AI Act (Regulation (EU) 2024/1689) and equivalent global AI ethics standards; they apply to any User whose deployment triggers the EU AI Act's extraterritorial scope (i.e., where AI system outputs are placed on the EU market or used within the EU), as well as to the extent that equivalent prohibitions apply under other applicable law. Innovatica's monitoring obligations are limited to technically feasible platform-level enforcement; these prohibitions do not expand Innovatica's obligation to affirmatively surveil deployments beyond what the platform technically enables.
- Subliminal manipulation: Deploying AI systems that use subliminal techniques or deliberately manipulative or deceptive techniques to influence persons in ways that impair their ability to make informed decisions or that cause or are reasonably likely to cause significant harm.
- Exploitation of vulnerability: Using AI to exploit vulnerabilities of specific groups by reason of their age, disability, or socioeconomic situation to distort their behavior in a way that causes or is reasonably likely to cause significant harm to those persons or others.
- Social scoring: Deploying AI for the evaluation or classification of natural persons or groups based on their social behavior or predicted personal characteristics, in a manner that leads to detrimental or unjustified treatment of those persons.
- Real-time biometric identification: Using AI for real-time remote biometric identification of natural persons in publicly accessible spaces for law enforcement purposes, except where permitted by applicable law.
- Prohibited emotion recognition: Deploying AI systems intended to infer the emotions of natural persons in workplace or educational settings, except where the system is intended for medical or safety reasons duly documented by the deployer.
- Prohibited biometric categorization: Using AI to perform biometric categorization of natural persons to deduce or infer their race, political opinions, trade union membership, religious or philosophical beliefs, or sexual orientation.
Violations of this Section are treated as material breaches and will result in mandatory suspension or termination of the relevant deployment under Section 8.2 of this Policy and Section 10.2 of the Terms of Service. Where required by applicable law, including Article 62 of the EU AI Act (market surveillance reporting obligations), Innovatica may report known violations to competent authorities.

4. AI AGENT SPECIFIC REQUIREMENTS¶
4.1 Agent Creator Responsibilities¶
As an AI Agent Creator, you must: - Ensure agents operate within legal and ethical boundaries - Implement appropriate safeguards and monitoring mechanisms - Provide clear descriptions of agent capabilities and limitations - Maintain proper access controls and permission settings - Monitor agent behavior and outputs for compliance - Address violations or issues promptly when identified
4.2 Agent Content Standards¶
AI Agents must not: - Generate content that violates any provision of this Policy - Be designed to circumvent platform safety mechanisms - Impersonate real individuals without appropriate disclosure - Generate misleading or false information about facts or events - Be used to manipulate, deceive, or harm users - Process personal data without appropriate legal basis and safeguards
4.3 High-Risk AI Applications (EU AI Act Annex III — applicable from 2 August 2026)¶
For AI systems that may pose significant risks under applicable law — including AI systems classified as high-risk under Annex III of the EU AI Act (Regulation (EU) 2024/1689), applicable from 2 August 2026 — the following requirements apply in addition to all other provisions of this Policy.
Annex III high-risk categories include (non-exhaustive): - Employment, workers management, and access to self-employment (e.g., CV screening, task allocation, performance monitoring) - Access to education and vocational training (e.g., student admission, exam assessment) - Access to essential private or public services (e.g., credit scoring, insurance risk assessment, emergency services) - Law enforcement (e.g., risk assessment of natural persons, deepfake detection, evidence evaluation) - Migration, asylum, and border control management - Administration of justice and democratic processes
Requirements for high-risk AI deployments: - Compliance assessment: Before deploying Brilio AI agents for high-risk applications, assess and document your compliance with applicable deployer obligations (EU AI Act Article 26 and equivalent requirements in other applicable jurisdictions). - Fundamental rights impact assessment: Conduct a fundamental rights impact assessment prior to deployment where required by Article 27 of the EU AI Act. - Enhanced testing and validation: Implement testing and validation procedures commensurate with the risk level and the population affected. - Transparency and disclosure: Clearly inform affected natural persons that they are subject to an AI system (or a decision supported by one), as required by applicable law, including EU AI Act Article 26(10) and Article 50. - Human oversight: Implement meaningful human oversight mechanisms — natural persons with the authority and capability to intervene, override, or stop the AI system. - Operational logging: Maintain logs of AI system operation as required by applicable law, to the extent within your control as deployer. - Registration: Register your deployment in the applicable regulatory database (e.g., EU database under EU AI Act Article 49) where required.
You must not use the Brilio platform for high-risk AI applications unless you have completed and can demonstrate compliance with all applicable obligations in your role as deployer. For role allocation and EU AI Act-specific provisions, see Terms of Service §12.7.
5. DATA AND PRIVACY REQUIREMENTS¶
5.1 Data Protection¶
When processing personal data through the Platform: - Ensure you have appropriate legal basis for processing - Implement adequate technical and organizational safeguards - Respect data subject rights and respond to requests appropriately - Comply with applicable data protection laws (GDPR, CCPA, etc.) - Provide clear privacy notices to affected individuals
5.2 Third-Party Data¶
You may not: - Upload personal data of third parties without proper authorization - Use the Platform to process data obtained illegally or unethically - Share or distribute personal data in violation of privacy laws - Use data for purposes incompatible with its original collection
5.3 Data Security¶
Implement appropriate measures to: - Protect data from unauthorized access or disclosure - Maintain data integrity and availability - Detect and respond to security incidents - Comply with data breach notification requirements
6. INTELLECTUAL PROPERTY COMPLIANCE¶
6.1 Copyright Respect¶
- Only upload content you own or have proper licensing for
- Respect copyright notices and attribution requirements
- Respond appropriately to takedown notices
- Do not use the Platform to facilitate copyright infringement
6.2 Trademark Compliance¶
- Do not use trademarks in ways that could cause confusion
- Respect trademark rights of third parties
- Comply with platform trademark usage guidelines
- Obtain proper permissions for trademark use when required
6.3 Trade Secrets and Confidential Information¶
- Do not upload or share trade secrets without authorization
- Respect confidentiality obligations and non-disclosure agreements
- Implement appropriate controls for sensitive business information
7. COMMERCIAL USE GUIDELINES¶
7.1 Legitimate Business Purposes¶
Commercial use of the Platform should: - Serve legitimate business objectives - Comply with applicable commercial and business laws - Respect consumer protection requirements - Follow advertising and marketing regulations
7.2 Prohibited Commercial Activities¶
You may not use the Platform for: - Deceptive or fraudulent business practices - Pyramid schemes or multi-level marketing scams - Unauthorized financial services or investment advice - Sale of illegal goods or services - Activities that violate consumer protection laws
8. ENFORCEMENT AND CONSEQUENCES¶
8.1 Violation Detection¶
We may detect policy violations through: - Automated monitoring and detection systems - User reports and complaints - Regular audits and reviews - Third-party notifications
8.2 Enforcement Actions¶
Depending on the severity and nature of violations, we may: - Issue warnings or require corrective action - Temporarily suspend account or agent access - Permanently terminate accounts or services - Remove or disable violating content or agents - Report illegal activities to appropriate authorities
8.3 Appeal Process¶
Users may appeal enforcement actions by: - Contacting our support team with detailed explanations - Providing evidence that the action was taken in error - Demonstrating corrective measures taken to address violations - Following our formal appeal procedures as outlined in our support documentation
